Terms of Service

1. Acceptance of Terms
By registering for an account, logging in, or using the services provided by KD Scepter (including but not limited to the dashboard, chatbot building features, scraped data training modules, and embeddable widget interfaces), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not sign in, register, or use the platform.
2. Description of Service
KD Scepter is a software-as-a-service platform that provides users with conversational AI tools. Users can upload custom documents, scrape web pages, customize widget layout and visual options, train models, view widget usage metrics, and collect user leads through embeddable conversational widgets. Services are subject to limits defined by your Stripe subscription plan tier.
3. Acceptable Use Policy
You agree that you will not use KD Scepter's platform or embedded widgets to:
- Collect or store sensitive information (e.g. medical data, social security numbers, banking credentials) through conversation lead prompts without appropriate legal authorization.
- Scrape websites that explicitly prohibit scraping or violate intellectual property laws by copying protected content.
- Engage in malicious activity, including spam, denial-of-service attacks, and attempts to compromise application security.
- Bypass rate-limiting, usage caps, or pricing plans configured on the platform.
4. Intellectual Property and Generated Content
KD Scepter maintains ownership over the chatbot widget code, dashboard, and underlying software structures. You retain ownership over raw training files, branding assets, and customer leads collected through your widgets. You are responsible for ensuring that all uploaded data complies with local copyright laws.
5. Disclaimer of Warranties
The service is provided on an "as is" and "as available" basis. KD Scepter makes no warranties, expressed or implied, regarding the continuous availability of custom widgets, accuracy of AI responses, or protection against service disruptions caused by external APIs.
6. Limitation of Liability
To the maximum extent permitted by law, KD Scepter and its operators will not be liable for any indirect, incidental, or consequential damages (including loss of profits, data, or business opportunities) arising from using the software, chatbot outages, or incorrect data generated by AI models.
7. Billing, Cancellation, and Refund Policy
- (a) Starter and Pro Tiers: Scepter Starter and Scepter Pro subscribers are eligible for a full refund within 7 days of their initial payment. Refund requests must be submitted to kdscepter@gmail.com within this 7-day window. After 7 days, all payments are strictly non-refundable.
- (b) Elite Tier: Scepter Elite subscribers are not eligible for refunds under any circumstances. Because the Elite plan requires a manual application and approval process involving dedicated onboarding resources, all Elite payments are final upon acceptance.
- (c) Cancellations: Cancellations can be made at any time. Upon cancellation, access continues until the end of the current billing period. After that, accounts are downgraded, and chatbots are locked but not deleted.
8. Suspension and Termination
- KD Scepter may suspend or terminate accounts violating the Acceptable Use Policy (Section 3).
- On suspension/termination, embedded chatbot widgets go offline immediately; account data is retained per the Privacy Policy's data retention terms.
9. White-Label Usage
- Pro/Elite tiers permit removing KD Scepter branding from embedded widgets for presentation to the customer's own end-users.
- White-labeling does not transfer ownership of underlying AI technology or platform code (per Section 4) and does not permit reselling API/platform access independent of the widget itself.
